The following General Terms and Conditions govern the contractual relationship between you as the booking party and the Lufthansa City Center as facilitator and the service providers (organisers). Lufthansa City Center expressly points out to all participants and travellers, that travel agreements are not concluded with Lufthansa City Center, but with the relevant service provider, subject to the General Terms and Conditions of the relevant service provider. Details and complete conditions can be obtained from our Service Center. A procurement agreement is established with the Lufthansa City Center. Therefore the following conditions apply exclusively to our procurement activity and shall have no impact on the conditions of organisers or airlines, according to which procured tours are arranged. The Lufthansa City Center is not obliged to check the information provided by the service providers and shall not be held liable against the booking party / participant / traveller for the correctness of information possibly provided by contractual partners, provided that Lufthansa City Center does not act grossly negligent or intentionally falsely in passing on this information or passes on this information despite grave concern about its correctness. The following General Terms and Conditions exclusively apply to the procurement agreement. The validity of any General Terms and Conditions of the booking party / participant / traveller are expressly excluded in as far as they do not correspond to the following General Terms and Conditions.

A binding booking order is established as soon as the booking party has clicked on the button "Send booking" in the mask. This is the legally binding order to the Lufthansa City Center, to procure a carriage or other tourism service from a specific service provider for the booking parties. Performance of the booked service as such does not form part of our obligations as travel agent. The booking party is bound to this booking order for a period of 72 hours. Lufthansa City Center will accept the booking order within this period of time or will contact the booking party. In principle a binding confirmation in form of an invoice from Lufthansa City Center is regarded as acceptance. If payment is made by credit card, charging of the credit card account of the booking party / participant / traveller is regarded as acceptance. Procurement is deemed to have been effected as soon as the travel documents have been dispatched to the customer. It is your obligation to immediately check the confirmation of booking / invoice / travel documents sent to you for correctness and to promptly point out any possible errors or deviations to the Lufthansa City Center, if applicable.
We hereby inform you that we do not save the text of the agreement. Together with our confirmation of the booking, you will receive an e-mail overview of the travel service, as selected by you, and the cost thereof.
Top of page 5. Liability of Lufthansa City Center as Agent
The scope of contractual services is incidental from the description of services of the tour operator or other provider, as well as from information in the confirmation of travel referring thereto. The Lufthansa City Center is not obliged to check the information of the tour operator or other provider and is not liable against a participant / traveller for the correctness or completeness of the information provided by possible contractual partners. Lufthansa City Center points out that the automatic confirmation of a booking, based on an accidental wrong input of data or on a software error, entitles Lufthansa City Center to contestation of a possibly concluded agreement.
Lufthansa City Center charges a ticket fee for the procurement of the tour. It is not refundable upon cancellation of the tour, unless the cancellation results from a fault by Lufthansa City Center and/or its vicarious agents. The customer is at liberty to prove that no or little costs have arisen.
Top of page 7. Change and Cancellation of Bookings
Changing a booked and confirmed tour is only possible by cancellation of the booked tour and concurrent booking of another tour, unless the service provider has got special provisions for such an instance. Possible costs for changing the booking or payable partial tour fees are subject to the conditions of the relevant service provider.
The option of cancellation of a booking is exclusively subject to the travel agreements / carriage agreements or the General Terms and Conditions of the relevant service provider and cannot be influenced by Lufthansa City Center. Depending on the ticket tariff, time of cancellation and service provider, it may in some cases occur that no refund will be made by the relevant service provider or airline. Details and complete conditions can be obtained from our Service Center. Partial refunding for legs not utilised is normally excluded in terms of the General Terms and Conditions of the airlines. Lufthansa City Center will provide information to the booking party to the best of its knowledge, but is not liable for either the correctness or the completeness of the information provided by the airlines.
The effective date and time for cancellation is the date and time of receipt of the cancellation in the Lufthansa City Center during normal business hours. We recommend doing the cancellation in writing, in order to avoid misunderstandings. It is imperative that the original air tickets be returned to Lufthansa City Center for the payment of any possible refund/partial refund.
In case of cancellation and/or change of booking, our claim for compensation for incurred expenses and for loss of procurement compensation remains unaffected. The customer is at liberty to prove that no or little costs have arisen. If it can be proven that the cancellation can be ascribed to poor performance by Lufthansa City Center, no consideration from the Lufthansa City Center shall accrue.
Lufthansa City Center recommends that the booking party takes out travel cancellation expenses insurance.
Provided that nothing else is mentioned in the individual tour descriptions or booking confirmations, the following conditions shall apply:
Scheduled flights and special offers
The conditions of the relevant airline shall apply. We advise that a change of booking or a cancellation will be subject to costs or may not be possible at all in many instances.
Hotel
The conditions of the provider indicated in the booking process shall apply.
Hired car
Special conditions of the booking of hire of cars apply. Kindly read the General Terms and Conditions of the relevant car rental agency.
Special and charter flights
The General Terms and Conditions of the relevant service provider / airline shall apply. All special and charter flights must be re-confirmed by the customer by not later than 48 hours before the return flight at the relevant airline or service provider. If this re-confirmation is not done, no claim for carriage exists. The conditions of carriage of the airline are binding.
Flights and/or other tourism services must be paid immediately after receipt of the invoice or provisional confirmation in full into the provided account, by credit card / debit note or by transfer, if you so choose. Lufthansa City Center reserves the right to cancel flights and all other tourism services which are not paid in due time and to charge any associated expenses to the customer. Only those payment methods mentioned on the website are accepted. No obligation to issue tickets, confirmations, vouchers or any other travel documentation exists before receipt of the full payment. The booking party / participant / traveller does, however, at any rate remain liable for the payment of agreed amounts for ordered travel services.
The Lufthansa City Center reserves the right to pass on any reversal costs to you in case of payment by credit card or by debit note returns. The customer is at liberty to prove that no or little costs have arisen in this instance.
If no e-ticket (electronic, paperless ticket) is booked or if the issuing of an e-ticket is not possible, travel documents will be sent by mail. If payment is effected by transfer, travel documents will be dispatched after receipt of payment. For short-term bookings travel documents are deposited at the airport or are dispatched by express courier service. The costs for dispatch and any possible deposit costs are for the account of the customer. They are not refundable upon cancellation of the tour, unless the cancellation results from a fault by Lufthansa City Center and/or its vicarious agents. Lost tickets are replaced according to the valid guidelines of the airline. Fees valid at the relevant time will be charged for replacement tickets. The customer is at liberty to prove that no or lower costs have arisen in this instance.
The scope of contractual services is established from the description of services in the offer or from information in the confirmation of the tour. The service providers expressly reserve the right of necessary changes of airlines, flight schedules, and the conversion of non-stop flights into flights with intermediate stops or transfer flights.
Unless something else has been expressly agreed, information about changes in flight schedules and/or flight cancellations will exclusively be communicated via the e-mail address stated during booking. We advise that all flights must be re-confirmed at least 48 hours before the flight or return flight at the relevant airline. If this re-confirmation has not been done and if the failure to re-confirm is causal for any possible claim for damages, then Lufthansa City Center shall not be liable.
Travel cancellation expenses insurance is not included in the prices. We recommend taking out a travel cancellation expenses insurance, which we can gladly arrange for you.
In principle every participant is responsible himself for the required preconditions for the tour to be complied with, and that all legal conditions, especially regarding local and foreign entry and exit requirements, health requirements, passport and visa requirements are observed. The same applies to the acquisition of required travel documents. We will diligently provide information on these aspects within the framework of our legal obligation, we can, however, not accept any liability for the information. We expressly advise that the conditions can at any time be changed by the authorities. It is therefore recommended to the participant to obtain information at the relevant offices himself. Remarks on our website (Homepage / Customer Service column) on passport, visa, currency or health regulations of your travel destination, it is assumed that you are a German citizen. If this is not the case, kindly contact the relevant embassy regarding this information.
The performance of services, to which the relevant service provider is obliged, is not subject matter of the contractual relationship existing with Lufthansa City Center. The relevant organiser or service provider is liable for these. Therefore no liability by the Lufthansa City Center exists for the performance of services by the relevant service providers. The Lufthansa City Center is, however, liable against participants for the proper procurement within the framework of due diligence duties of a proper businessman.
Regarding information about individual tours we are dependent on the information provided to us by the organisers. Lufthansa City Center is not in a position to verify all of this information for correctness. Therefore the Lufthansa City Center cannot furnish any guarantees or assurances to you regarding the correctness, completeness or state of being up-to-date of this information. The same applies to other information contained on this website, being provided by third parties.
Lufthansa City Center shall appropriately endeavour to ensure that the information and other data available on the website, especially regarding prices, limitations and dates, is current, complete and correct at the time of publishing. If, however, a booking with non-applicable data (price, dates, flight class, etc.) should become effective due to a technical error, Lufthansa City Center herewith expressly reserves the right to contestation of such procurement agreement within the framework of the relevant legal regulations.
Lufthansa City Center also is neither liable for the availability of the tour at the time of booking nor for the performance of the booked tour.
Every liability of the Lufthansa City Center is limited to intentional and gross negligence, unless substantial contractual obligations are being violated.
For slight negligence the Lufthansa City Center is only liable for typical and predictable damages.
In case of slight negligence liability of Lufthansa City Center is limited in each individual case to the maximum amount of the booked services, from which the claim results.
All claims for damages are subject to a limitation period of 12 months after origination. This does not apply to claims resulting from unlawful act.
The aforementioned liability limitations do not apply to claims arising from the Product Liability Act or other guarantee liabilities. The same applies to loss of life encumbered by Lufthansa City Center or to injury to body or health, for which Lufthansa City Center is responsible.
In as far as liability of the Lufthansa City Center is excluded, this exclusion of liability also applies to employees, legal representatives and vicarious agents of Lufthansa City Center.
Acts of God which completely or partially impair the discharge of duties of the Lufthansa City Center, releases Lufthansa City Center form the discharge of its duties until such acts of God are no longer present.
Every booking party bears the risk of abusive utilisation of its password. Lufthansa City Center can only point out that the user name and password should always be treated as confidential.
The booking order will be processed subject to the valid relevant data protection regulations. The Lufthansa City Center binds itself only to use the data collected, processed and saved during login and use of Lufthansa City Center services by the relevant user, for purposes of processing of agreements arising from the co-operation of Lufthansa City Center, and not to pass it on to third parties, provided that no legal or official obligation therefore exists, e.g. for the combating of abuse, especially abuse of credit cards. Participant data collected during login may be forwarded to the relevant service providers, in as far as this is necessary for the processing of concluded agreements. Your personal data, like for instance date of birth and names of co-travellers, may be required in certain instances if this is required for processing the booking. This additional data is not saved after completion of the journey.
This website contains hyperlinks, leading to websites of outside providers. The Lufthansa City Center does not have any influence on their layout and contents and does therefore not accept any guarantee for the correctness, state of being up-to-date, completeness and quality of information presented there. The Lufthansa City Center also distances itself expressly from all contents of these external websites. Kindly direct all concerns you might have in connection with any such website to the relevant operator of the website.
Top of page 19. Changes of General Terms and Conditions
The Lufthansa City Center reserves the right to change or revise the General Terms and Conditions regarding utilisation of this website at any time, with future effect, without any obligation of informing users. The respective current version of the General Terms and Conditions will be available on the website.
If any one of the aforementioned conditions should prove to be ineffective or unenforceable, the effectiveness of the remaining conditions remains unaffected.
The Lufthansa City Center herewith expressly advises that the procurement of travel services according to § 312 b Par. 3 No. 6 of the German Civil Code, is not subject to the provisions of the Distance Selling Act. This specifically applies to the sale of flight tickets. This means that the customer is not entitled to right of withdrawal or right of return against the Lufthansa City Center.
German law shall apply exclusively for any disputes from or connection with this agreement. Provided that the person logging in or the traveller is a general merchant, he can only sue the Lufthansa City Center at the Head Office of the Lufthansa City Center.
